VenturEd Solutions Online Terms of Service

These Online Terms of Service (“Terms”) apply to individual users accessing the VenturEd Solutions platform. 

If you are accessing the Services through a school or organization that has a separate written agreement with VenturEd, that agreement governs the services provided to the institution. These Terms apply only to your personal use of the platform and do not modify or replace any Institution Agreement. 

  1. Parties and Roles

VenturEd Solutions (“VenturEd,” “we,” “us”) provides application and financialaid processing software to educational institutions (“Schools”). 

Schools are the owners and controllers of application data. VenturEd acts solely as a service provider/processor on behalf of Schools. 

If you are a parent, guardian, student, or applicant (“User”), your relationship regarding submitted information is primarily with the School you selected. 

Except as expressly provided in a written agreement between VenturEd and a School, these Terms do not create any thirdparty beneficiary rights in any Institution Agreement. Individual users may not assert rights under any agreement between VenturEd and a School. 

  1. Acceptance of Terms

You may use the Services only if you: 

  • Are authorized to submit the information 
  • Provide accurate information 
  • Comply with these Terms and applicable laws 

Use of the Services also constitutes acknowledgment of the Privacy Policy available at: https://www.venturedsolutions.com/ventured-solutions-privacy-policy/.

  1. PermittedUse 

The Services may be used solely to: 

  • Submit school applications 
  • Provide financial information for aid evaluation 
  • Communicate with participating Schools 

You agree not to: 

  • Provide false or misleading information 
  • Impersonate another person or entity 
  • Attempt to access other users’ accounts or school data 
  • Upload malicious code or harmful files 
  • Interfere with system security or performance 
  • Use automated scraping tools or bots 
  • Reverse engineer or exploit the platform 
  • Use the Services for unlawful purposes 

VenturEd may suspend or restrict access for violations of these Terms. 

  1. Account Security

You are responsible for maintaining the confidentiality of login credentials and all activity under your account. You must notify VenturEd immediately of unauthorized access. 

VenturEd implements reasonable administrative, technical, and physical safeguards designed to protect the Services; however, no system can be guaranteed completely secure.  

VenturEd may suspend accounts to protect system integrity, enforce these Terms, or comply with legal requirements. 

  1. Information Submitted and User Content License

You represent that: 

  • All information submitted is truthful 
  • You have authority to submit the data 
  • You understand Schools make all admissions and financial aid decisions 

You grant VenturEd a limited, nonexclusive license to host, process, transmit, and display submitted content solely to provide the Services. 

VenturEd does not evaluate eligibility or determine awards and does not provide financial, tax, educational, or legal advice. 

  1. Data Ownership and FERPA

All application information belongs to the School. VenturEd processes information only under School instructions and acts as a School Official with legitimate educational interest under applicable student privacy laws. 

Requests to access, correct, or delete application information must be directed to the School. 

  1. Communications and SMS

VenturEd may send informational communications regarding application status, account activity, or security alerts. 

If you opt in to SMS messaging, you agree to receive text messages as described in the SMS Terms & Conditions available at: https://www.venturedsolutions.com/sms-terms-conditions/. Message frequency varies and message/data rates may apply. You may opt out by replying STOP. 

You consent to receive electronic communications, and such communications satisfy legal notice requirements. 

  1. ThirdPartyServices 

The Services utilize sub processors including hosting providers and tax data processing services. These providers process information only to support the Services. 

VenturEd is not responsible for independent actions, decisions, or data usage by Schools or thirdparty systems. 

  1. Availability

VenturEd strives to maintain availability but does not guarantee uninterrupted service. Maintenance, security events, or external factors may affect access. 

VenturEd is not liable for failures caused by events beyond reasonable control including internet outages, hosting provider failures, or governmental actions. 

  1. Retention

Information is retained as required by law, contract, or School instructions, generally up to seven (7) years unless otherwise required. 

  1. Intellectual Property

All platform software, interfaces, and content are owned by VenturEd or its licensors. You may not copy, modify, distribute, or create derivative works except as permitted. 

  1. Disclaimer of Warranties

The Services are provided “as is” and “as available.” VenturEd disclaims all warranties, including merchantability, fitness for a particular purpose, and noninfringement, to the extent permitted by law. 

  1. Limitation of Liability

To the maximum extent permitted by law, VenturEd shall not be liable for indirect, incidental, consequential, or punitive damages, including decisions made by Schools using submitted information. 

VenturEd’s total liability arising out of or relating to the Services shall not exceed $100 or the amount paid for use of the Services in the preceding 12 months, whichever is greater. 

  1. Indemnification

You agree to indemnify and hold VenturEd harmless from claims arising from your misuse of the Services, violation of these Terms, or inaccurate information you submit. 

  1. Termination

VenturEd may suspend or terminate access to protect the Services, comply with law, or at the direction of a School. Sections relating to liability, intellectual property, and indemnification survive termination. 

  1. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, excluding conflictoflaw rules.  

  1. Public Entity Customers

If a School is a governmental or public educational institution, the following apply to the extent required by applicable law: 

  • Nothing in these Terms waives or limits the School’s sovereign immunity or statutory limitations of liability 
  • Indemnification obligations apply only to the extent permitted by law 
  • Venue and governing law provisions apply except where prohibited by statute 
  • VenturEd acknowledges that certain records may be subject to public records or freedom of information laws 
  • Any conflicting provisions in a written agreement with the governmental School shall control 
  1. Changes to Terms

VenturEd may update these Terms from time to time. We will post any changes on this website and update the “Last Updated” date above. Your continued use of the Services after the revised Terms are posted constitutes acceptance of the updated Terms.
